This is one of the highest boards of people in the United States. Anything you want appealed in regards to US citizenship will have to pass through this board. This board consists of eleven board members and their decisions are final and legally binding. Cases are reviewed as paper cases instead of courtroom proceedings. Before any paper cases reach the Board of Immigration Appeals it must go through Department of Justice.

The majority of immigration appeals are from individuals that are deported from the United States. For example, a person that is in the process of naturalization and does not US citizenship that is charged with a felony crime can be deported from the United States. These individuals can then file a claim to the immigration appeals to have the decision to deport them reversed. Other individuals that are working illegally in the United States can also be deported. Like the ones charged with felony crimes, these individual can send their case to immigration appeals to try and remain in the US and obtain a green card or work vista.

Some of the immigration attorneys are filing for temporary stays of deportation status of individuals. This means that while the paperwork and the process of the immigration appeals is occurring the individual is allowed to remain in the United States. They are not automatically deported back to their home country. There has been an increase in the number of immigration appeals in recent years and this has increased the burden on the Board of Immigration Appeals to process the paper cases in a timely manner. Having a case reviewed for immigration appeals can be a lengthy process. The use of temporary stays means that many individuals that were going to be sent out of the United States immediately are finding several months of temporary relief.

During recent years there have been numerous immigration law reforms and changes. The result of these changes is that many more people are violating the rules and thus are not being qualified for US citizenship or even being put on deportation status. Additionally, there has been decrease in the amount of funding for the immigration appeals process. A major complaint is that many times the immigration appeals that are being requested are not being reversed because of political reasons and budget constraints. The entire process in recent years has fell under a lot of controversy and complaints from the general public, immigrants and from immigration lawyers. Expect to wait a while for a final decision from the Board of Immigration Appeals.
